1. Who provides the service

The service is provided by Makespan (makespan.se). Contact: info@makespan.se.

2. The service

Makespan is a production-planning tool that converts order data into production schedules using mathematical optimization. The service is currently in a development/prototype stage and is provided as is. It may be changed, limited or discontinued without prior notice.

3. Accounts and access

• Access requires an account created by invitation.
• You are responsible for keeping your login credentials secret and for activity on your account.
• You may not share your account or attempt to access data that does not belong to your company.

4. Permitted use

You may not:

• use the service for illegal purposes,
• attempt to circumvent security, access control or other companies' data isolation,
• disrupt operations (e.g. overloading, automated mass uploads),
• attempt to copy, deconstruct or recreate the optimization model.

5. Your content and data

• You (or your employer) retain ownership of the data you upload.
• You grant us the right to process the data to the extent required to deliver the service.
• How we handle personal data is described in our privacy policy.
• If the data you upload contains personal data (e.g. employee names) we act as a data processor for your organization. Contact us at info@makespan.se if you need a data processing agreement (DPA) under GDPR art. 28.

6. Intellectual property

The service, its code, design and optimization model belong to us (or our licensors) and are protected. Nothing in these terms transfers ownership to you.

7. Availability

The service is provided without any guarantee of availability or uptime. As it is in a prototype stage, interruptions may occur. No service level (SLA) is promised at this time.

8. Limitation of liability

The service is provided as is without warranties of availability, accuracy or fitness for a particular purpose. To the extent permitted by law, we are not liable for indirect damages, lost profits or loss of data resulting from use. Nothing in these terms limits liability that may not be limited under mandatory law.

9. Termination

We may suspend or terminate access upon breach of the terms or if operations cease. You may stop using the service at any time and ask us to delete your account.

10. Changes

We may update the terms. Material changes will be communicated in an appropriate manner. The latest version is always on this page.

11. Governing law and disputes

Swedish law applies. Disputes are settled by Swedish general courts.
